1. Who We Are
These Terms and Conditions govern the use of romebyvespa.com and the booking of tours operated by Rome by Vespa di Francesco Lapenna, VAT number 02393090747, registered office at Via Giuseppe Ravizza 42, 00149 Rome, Italy, email romebyvespatour@gmail.com, phone/WhatsApp +39 380 643 2278 ("we", "us", "Rome by Vespa").
2. Services Offered
Guided Vespa tours including: Vespa Tour – As Passenger, Vespa Tour – As Driver (Self-Drive), Vespa Food Tour, and Private Vespa Tour. Tour details (duration, meeting point, price, inclusions) are described on the relevant tour page at the time of booking.
3. Bookings and Payment
Bookings are made through our website or authorized third-party platforms (e.g. GetYourGuide, Viator, Tripadvisor). Payment is processed securely via Stripe. Full or partial payment may be required at the time of booking, as indicated on the tour page. A booking is confirmed only once payment has been successfully processed and a confirmation has been issued.
4. Self-Drive Requirements
Participants must be at least 18 years old and hold a valid driving licence appropriate for a 125cc scooter. Non-EU/UK/Switzerland/Israel licence holders generally require an International Driving Permit (IDP), as required by Italian law. Prior riding experience in city traffic is required; Self-Drive is not suitable for beginners. A refundable security deposit of €500 is required before the tour, returned after the tour if no damage has occurred, subject to our vehicle inspection. We reserve the right to refuse the Self-Drive option, and offer the Passenger option instead, if we reasonably determine a participant does not meet these safety requirements. Any traffic fines or legal consequences arising from non-compliance with Italian driving requirements (including a missing IDP) remain the sole responsibility of the participant.
5. Cancellation and Refund Policy
Free cancellation is available up to 48 hours before the scheduled tour start time, for a full refund. Cancellations made less than 48 hours before the tour are non-refundable, except where required by law. In case of adverse weather or circumstances beyond our control that make the tour unsafe, we will offer a reschedule or a full refund, at the customer's choice.
6. Conduct and Safety
All participants must wear the helmet provided at all times while riding, and must follow the guide's instructions and the Italian Highway Code (Codice della Strada) at all times. We reserve the right to interrupt the tour, without refund, if a participant's behaviour endangers themselves or others.
7. Liability and Insurance
Vespas used for Self-Drive tours are covered by insurance as required by Italian law; the security deposit referenced in Section 4 relates to this coverage. Rome by Vespa is not liable for indirect, incidental, or consequential damages, except where liability cannot be excluded under mandatory Italian consumer protection law. Participants take part at their own risk and are responsible for ensuring they are medically fit to ride or be a passenger on a scooter.
8. Photos and Intellectual Property
Photos or videos taken during the tour by our guides may be used for marketing purposes (e.g. website, social media), unless you notify us that you do not wish to be included. All content on romebyvespa.com (text, images, logos) is owned by or licensed to Rome by Vespa and may not be reproduced without permission.
9. Governing Law and Jurisdiction
These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the competent court in Rome, Italy, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
10. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of booking will apply to that booking.
